I have asked this before, I just need a few more opinions. I am consulting with a surgeon on Friday.?It is to get a tumor removed from my scalp> (it is through a genetic disorder). If I need to get it removed, it is a minor surgical procedure. I am thinking that I will need a few days off from work.

My question is : Can they deny me my time off, I have 4 sick days left for the year, (we are given 6) and One floater day, and can they fire me for this.

Our office is extremely short handed right now, one person is off on a sabbatical, and after that she is going to have a Knee replacement surgery, and one is going to be going on maternity leave very soon. I have been with this company 17 years. I just want to get this over with.

You have four days, have the surgery on a Friday or Thursday. You will be ready to go back to work on Monday.
Only your company can tell you about your sick days, if they are going to fire you, they won't be doing it when they are already shorthanded.

This is not like you are getting cosmetic surgery done. No, if you have the sick time, I don't think they can fire you. Just make sure that you will not need more than 4 days off before you get the surgery done. Also, is this something that is life-threatening? They cannot deny you if it is.

I am sure you can call the labor board and ask what the employment law is about this issue. I think laws differ from state to state but I cannot imagine you can be fired for taking a day off for surgery...elective or not. But check your states employment laws. There should be something posted in your workplace about your rights.

I know what it is like to feel guilty for missing work. Just remember that you need to take care of yourself first. If the surgery is something that can be put off for a while or not serious then you might want to schedule it later and let your office manager know ahead of time. I don't think they can fire you for missing work sick. If so contact the civil liberty association for help. You sound like a very loyal employee. I am sure they don't want to loose you. Best of luck.

Sometimes if you fit the definition of "key employee" they could have the right to let you go if you exceed your sick time.

However, if you have been with the company longer that a year you can apply for FMLA which is a national madated law and you would be eligible for up to 12 weeks of unpaid leave.

If you haven't been with the company longer than a year, some companies allow you to borrow sick time as well.

Don't you have any HR people to discuss your issue with?
